A legal disclaimer

1. Scope of Services

Ergolavos LLC (“Company”) provides pavement marking services including, but not limited to: parking lot striping, ADA-compliant markings, fire lane striping, signage installation, seal coating preparation markings, and layout design.

All services will be performed as outlined in the written estimate, proposal, or contract approved by the customer (“Client”).

Terms & Conditions - the basics

2. Estimates & Pricing

All estimates are valid for 30 days unless otherwise stated.
Pricing is based on current site conditions. Any unforeseen conditions (e.g., excessive surface damage, obstructions, or layout changes) may result in additional charges.
Changes requested after approval may require a revised estimate.

3. Scheduling & Access

The Client must provide clear and safe access to the work area at the scheduled time.
All vehicles, debris, and obstacles must be removed prior to service.
Delays caused by lack of access may result in rescheduling fees.

4. Surface Conditions

The Company is not responsible for issues caused by pre-existing pavement conditions, including cracks, potholes, oil stains, or surface deterioration.
Striping durability depends on surface condition and proper maintenance.
The Company recommends seal coating prior to striping when necessary.

5. ADA Compliance Disclaimer

Ergolavos LLC will perform ADA markings based on industry standards and provided specifications.
Final compliance is the responsibility of the property owner.
The Company is not liable for compliance issues due to inaccurate site measurements, outdated regulations, or changes in local/state/federal laws.

6. Weather Conditions

Services are weather-dependent.
The Company reserves the right to reschedule due to rain, moisture, or extreme temperatures that affect paint adhesion and quality.

7. Payment Terms

Payment terms will be outlined in the estimate or invoice.
A deposit may be required prior to scheduling.
Full payment is due upon completion unless otherwise agreed in writing.
Late payments may incur interest or collection fees.

8. Cancellations & Rescheduling

Cancellations must be made at least 24–48 hours in advance.
Late cancellations may result in a cancellation fee.
The Company reserves the right to reschedule due to operational or weather-related reasons.

9. Warranty & Limitations

The Company may offer a limited workmanship warranty (if stated in writing).
Warranty does not cover:
- Normal wear and tear
- Damage from traffic, weather, or misuse
- Failure due to poor surface conditions
No other warranties, expressed or implied, are provided.

10. Liability

The Company is not responsible for damage caused by:
- Vehicles entering wet paint areas
- Failure of Client to secure the work zone
Client agrees to keep all traffic off freshly painted surfaces for the recommended drying time.
Liability is limited to the cost of the services provided.

11. Indemnification

The Client agrees to indemnify and hold harmless Ergolavos LLC from any claims, damages, or liabilities arising from the use of the property or failure to maintain markings after completion.

12. Governing Law

This agreement shall be governed by the laws of the State of Texas.

13. Acceptance of Terms

By approving an estimate, signing a contract, or allowing work to begin, the Client agrees to these Terms & Conditions.
